This Terms of Service (“Terms”) constitutes a legally binding agreement between you (“User”, “Customer”, “Buyer”) and Digital Trendz Private Limited, a company incorporated under the Companies Act, 2013, having its registered office at Plot #19, Jadiyawadi Compound, Beside SAR Corporate Center, Udhana Main Road, Surat – 395002, Gujarat, India (hereinafter referred to as the “Company”, “we”, “us”, or “our”). The Company owns and operates the brand Aadita and the e-commerce website www.aaditafashion.com (“Website”), which is hosted and powered by Shopify Inc. (“Shopify”), a third-party platform that enables us to provide our products and services to you.
By accessing, browsing, or using this Website, or by placing an order, you agree to be bound by these Terms along with all policies referenced herein, including but not limited to the Privacy Policy, Refund Policy, and Shipping Policy. If you do not agree to these Terms, you must not use the Website or avail any of our services.
You represent and warrant that you are at least 18 years of age and competent to contract under the provisions of the Indian Contract Act, 1872. If you are accessing the Website on behalf of another entity, you confirm that you are authorized to bind such entity to these Terms.
You agree to provide accurate, complete, and current information during account creation and purchase. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. The Company reserves the right to suspend or terminate your account in cases of fraud, misrepresentation, misuse, or breach of these Terms.
The Website caters to both retail (B2C) and business (B2B/wholesale) customers. For retail customers, all product prices displayed on the Website are inclusive of applicable Goods and Services Tax (GST). For business customers, prices are exclusive of GST, and valid GST registration details must be provided at the time of purchase for issuance of a tax invoice in compliance with applicable GST laws.
The Company reserves the right, at its sole discretion, to classify any user as a B2C or B2B customer, to grant or restrict access to wholesale pricing, and to cancel orders in cases of misuse, misrepresentation, or violation of applicable laws.
The Company endeavors to display accurate product descriptions, images, and specifications. However, you acknowledge that variations in color, finish, and appearance may occur due to differences in screen settings, lighting conditions, or manufacturing processes.
All products sold under the brand Aadita are fashion/artificial jewellery. Such products are subject to normal wear and tear over time. Exposure to moisture, sweat, perfumes, cosmetics, or chemicals may result in fading, tarnishing, or deterioration. The Company does not guarantee lifetime color retention, plating durability, or suitability for all skin types. Any such changes arising from regular use shall not be considered a manufacturing defect.
Placing an order on the Website constitutes an offer to purchase. The Company reserves the absolute right to accept or reject any order at its sole discretion. An order shall be deemed accepted only upon confirmation by the Company.
The Company may cancel orders in circumstances including but not limited to pricing errors, stock unavailability, suspected fraudulent activity, bulk purchasing beyond permissible limits, or non-serviceable delivery locations. In such cases, any payments received shall be refunded in accordance with applicable policies.
All prices are subject to change without prior notice. In case of any pricing or typographical error, the Company reserves the right to cancel the order.
For B2C customers, prices are inclusive of GST, whereas for B2B customers, GST shall be charged additionally as applicable. Payments are processed through authorized third-party payment gateways integrated via Shopify. In the event of payment failure or technical errors resulting in deduction of funds, refunds shall be processed as per the timelines of the respective payment service provider.
The Company shall make reasonable efforts to ensure timely dispatch and delivery of products. However, delivery timelines are indicative and not guaranteed. Delays may occur due to logistics partners, weather conditions, or other unforeseen circumstances.
The Company shall remain responsible for the shipment until delivery to the customer. In case of loss or damage during transit, the Company will coordinate with the logistics partner to resolve the issue. However, the Company shall not be liable for delays or failures caused by events beyond its reasonable control.
The Company reserves the right to offer or restrict Cash on Delivery (COD) as a payment option based on internal risk assessment, location, or order history. Repeated refusal or non-acceptance of COD orders may result in suspension of COD privileges, account restriction, or cancellation of future orders without prior notice.
All return, refund, and exchange requests shall be governed by the Company’s Refund Policy available on the Website. Products must be returned unused, in original condition and packaging, within the specified timeline.
The Company reserves the right to reject returns in cases where products are found to be used, damaged due to misuse, or inconsistent with the nature of fashion jewellery. Refunds may be issued as store credit, replacement, or other forms as specified in the Refund Policy.
All content on the Website, including but not limited to text, images, product designs, logos, graphics, and layout, is the exclusive property of Digital Trendz Private Limited and is protected under applicable intellectual property laws in India. Unauthorized use, reproduction, or distribution of such content is strictly prohibited and may result in legal action.
The Website is hosted on Shopify, which provides the e-commerce platform enabling us to sell our products and services. However, all transactions, purchases, and interactions are solely between you and the Company. Shopify shall not be held responsible for any aspect of your transactions with us, including but not limited to product quality, delivery, refunds, or disputes.
Additionally, the Website may include third-party tools, payment gateways, or external links. The Company shall not be liable for any issues arising from the use of such third-party services.
All products and services are provided on an “as is” and “as available” basis without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted under applicable Indian laws, Digital Trendz Private Limited shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or business opportunities arising from the use of the Website or purchase of products.
You agree to indemnify and hold harmless the Company, its directors, officers, employees, and affiliates from any claims, liabilities, damages, or expenses arising out of your breach of these Terms, misuse of the Website, or violation of any applicable laws.
The Company reserves the right to suspend or terminate your access to the Website at its sole discretion, without prior notice, in case of violation of these Terms or any unlawful activity.
The Company shall not be held liable for any delay or failure in performance due to events beyond its reasonable control, including but not limited to natural disasters, pandemics, strikes, governmental actions, or disruptions in logistics services.
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising shall be subject to the exclusive jurisdiction of the competent courts in Surat, Gujarat.
The Company reserves the right to update or modify these Terms at any time without prior notice. Continued use of the Website after such changes constitutes acceptance of the revised Terms.
